SparkEd Math ("SparkEd", "we", "us", or "our") is operated from India and is committed to protecting the privacy of every user. This Privacy Policy explains how we collect, use, store, and protect your personal data in accordance with the Digital Personal Data Protection Act, 2023 (DPDP Act), the Information Technology Act, 2000 (IT Act), and the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011.

  • Account information: Name, email address, class/grade, and education board (CBSE, ICSE, IB, or Olympiad) when you create an account.

2. How We Use Your Information

We use the collected data for the following lawful purposes:

  • To provide and personalise the SparkEd Math learning experience.
  • To track your learning progress and generate performance reports.
  • To improve our platform, content quality, and features.
  • To communicate important updates about the service.
  • To ensure platform security and prevent misuse.

3. Children's Data Protection

SparkEd Math primarily serves students in Classes 6–10. In compliance with Section 9 of the DPDP Act, 2023, which provides enhanced protections for children's personal data:

  • We obtain verifiable parental or guardian consent before processing the personal data of any child (under 18 years of age as defined under the DPDP Act).
  • We do not engage in tracking, behavioural monitoring, or targeted advertising directed at children.
  • We do not process children's data in any manner that could cause harm to their well-being.
  • Data collected from children is limited to what is strictly necessary for providing educational services.

4. Data Storage & Security

Your data is stored securely using industry-standard encryption and security practices as required under the IT Act, 2000 and its associated Rules. We implement reasonable security practices and procedures including:

  • Encryption of data in transit (TLS/SSL) and at rest.
  • Access controls limiting data access to authorised personnel only.
  • Regular security audits and vulnerability assessments.
  • Secure authentication mechanisms for user accounts.

Data may be stored on servers located outside India (through our cloud service providers). In such cases, we ensure adequate safeguards are in place as required under applicable law.

5. Data Sharing

We do not sell, rent, or trade your personal data. We may share data only in the following circumstances:

  • Service providers: With trusted third-party services (such as Firebase/Google Cloud and analytics tools) that help us operate the platform, subject to appropriate data processing agreements.
  • Legal obligations: When required by law, court order, or government authority under Indian law.
  • Safety: To protect the rights, safety, or property of SparkEd, our users, or the public.

6. Your Rights

Under the DPDP Act, 2023, you have the following rights as a Data Principal:

  • Right to Access: Request information about the personal data we hold about you.
  • Right to Correction: Request correction of inaccurate or incomplete personal data.
  • Right to Erasure: Request deletion of your personal data, subject to legal retention requirements.
  • Right to Withdraw Consent: Withdraw your consent for data processing at any time. This may affect your ability to use certain features.
  • Right to Grievance Redressal: File a complaint with our Grievance Officer or escalate to the Data Protection Board of India.

We retain personal data only for as long as necessary to fulfil the purposes described in this policy, or as required by applicable Indian law. When data is no longer needed, it is securely deleted or anonymised.

Terms of Service

By accessing or using SparkEd Math, you agree to be bound by these Terms of Service. If you are under 18 years of age, your parent or legal guardian must agree to these terms on your behalf.

1. About the Service

SparkEd Math is a free online mathematics learning platform designed for students in Classes 6–10 across CBSE, ICSE, IB, and Olympiad curricula. The platform provides practice questions, visual solutions, AI-powered coaching, progress tracking, and tests.

2. Eligibility

SparkEd Math is intended for students, parents, and educators in India and worldwide. Users under 18 years of age must have the consent of a parent or legal guardian to create an account and use the platform, in compliance with the DPDP Act, 2023.

3. Free Access

All features of SparkEd Math are currently offered completely free of charge. There are no hidden fees, trial periods, subscriptions, or in-app purchases. We reserve the right to introduce optional paid features in the future, but existing free features will remain accessible.

4. User Accounts

  • You may use SparkEd Math without creating an account. However, an account is required to save progress across devices.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You agree to provide accurate information during registration.
  • We reserve the right to suspend or terminate accounts that violate these terms.

5. Acceptable Use

You agree not to:

  • Use the platform for any unlawful purpose or in violation of any applicable Indian or international law.
  • Attempt to gain unauthorised access to any part of the platform, its servers, or databases.
  • Reproduce, distribute, or commercially exploit any content from SparkEd Math without prior written permission.
  • Use automated tools (bots, scrapers) to access the platform without permission.
  • Upload harmful content, malware, or engage in any activity that disrupts the service.

6. Intellectual Property

All content on SparkEd Math — including questions, solutions, visual explanations, AI-generated content, images, logos, and software — is owned by SparkEd or its licensors and is protected under the Copyright Act, 1957 and other applicable Indian intellectual property laws. You may use the content solely for personal, non-commercial educational purposes.

7. AI-Powered Features

SparkEd Math uses artificial intelligence (including the Spark Coach feature) to provide personalised learning assistance. AI-generated content is provided for educational guidance and may not always be perfectly accurate. We encourage students to verify important information with their teachers or textbooks.

8. Disclaimers

  • SparkEd Math is provided on an "as-is" and "as-available" basis.
  • We do not guarantee uninterrupted access or that the platform will be error-free.
  • SparkEd Math is a supplementary learning tool and is not a substitute for school instruction or professional tutoring.
  • We are not responsible for any academic outcomes or exam results.

9. Limitation of Liability

To the maximum extent permitted under Indian law, SparkEd shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform. Since the service is provided free of charge, our total liability shall not exceed ₹100 (Indian Rupees One Hundred).

10. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising from the use of SparkEd Math shall be subject to the exclusive jurisdiction of the courts in India.

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated through the platform or via email. Continued use of SparkEd Math after changes constitutes acceptance of the revised terms.

Data Protection

SparkEd Math complies with all applicable Indian data protection laws, including the Digital Personal Data Protection Act, 2023. Below is a summary of our data protection commitments.

Lawful Basis for Processing

We process personal data based on your consent (provided during account registration or, for children, through verifiable parental consent) and for legitimate purposes necessary to provide the educational service.

Data Minimisation

We collect only the minimum personal data necessary to deliver our educational services. We do not collect sensitive personal data (such as financial information, biometrics, or health data) as defined under Rule 3 of the IT (SPDI) Rules, 2011.

Cross-Border Data Transfer

Some data may be processed by our cloud service providers (such as Google Firebase) on servers located outside India. Such transfers comply with the requirements of the DPDP Act, 2023 and applicable rules regarding cross-border data transfer.

Data Breach Notification

In the event of a data breach that poses a risk to your rights, we will notify the Data Protection Board of India and affected users as required under the DPDP Act, 2023, within the prescribed timelines.

Refund Policy

SparkEd Math is currently offered completely free of charge. All features, topics, difficulty levels, coaching tools, and tests are available to every user at no cost.

Since no fees are charged at this stage, there are no payments and therefore no refunds applicable.

In the future, should we decide to introduce any paid features or pricing plans, a comprehensive refund policy will be published here in accordance with the Consumer Protection Act, 2019 and applicable Indian laws. Any such changes will be communicated to users in advance.

Contact & Grievance Redressal

In accordance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 and the DPDP Act, 2023, we have appointed a Grievance Officer to address your concerns regarding data privacy and platform usage.

Escalation
